Donos de grupos de Whats poderão ser punidos por fakes dos amigos com nova lei

Especialista em direito digital fala sobre o assunto, que possui projeto de lei tramitando no Senado

Em tramitação no Senado, o projeto de lei 246/2018 prevê punições mais rígidas para a divulgação de notícias falsas, as populares fake news.

Entrevistado pelo TopMídiaNews, Raphael Chaia, advogado especialista em direito digital e professor da UCDB, destaca que a proposta, se aprovada, prevê punições para donos de grupos de WhatsApp onde são divulgadas as informações falsas. 

O texto prevê propositura de ação civil pública contra notícias falsas que atinjam interesses coletivos, neste caso, tendo como órgãos de solicitação o Ministério Público, Estado, Defensoria ou União.

“A lei de ação civil pública prevê indenização ou reparação de danos que sejam causados ao consumidor, meio ambiente e pode ser usado quando houver danos em interesses difusos coletivos, ou seja, que cause dano a várias pessoas ao mesmo tempo”, diz o professor.

Combate ao problema

Mas com a aprovação da lei, o problema será resolvido em 100%? Parao professor, não. Ele aponta que a questão será: quem irá dizer o que é fake news? 

Esse ano, por exemplo, uma decisão errada do STF (Supremo Tribunal Federal) determinou que os jornais “Crusoé e O Antagonista” retirassem do ar uma reportagem que citava o ministro Dias Toffoli. O STF alegou que a notícia era falsa num primeiro momento e, após checagem, voltou atrás da decisão.

Solução

Para o especialista, além dos veículos de comunicação agirem com a mesma rapidez em divulgar a verdade, existe a questão de acesso à informação.

Raphael acredita que as assinaturas de jornais online para ver o conteúdo podem prejudicar a divulgação da verdade, frente às notas falsas distribuídas de forma gratuita.

“O problema, no Brasil, é que combatem problemas novos com soluções velhas. Se você derruba o WhatsApp com liminar, não funciona. Mentira a gente resolve com a verdade”, diz. 

Ele ainda salienta que o investimento em agências de checagem nacionais vinculadas a IFCN (International Fact-Checking Network) seria vantajoso pela confiança de fontes.
